Appeals
Against Conviction/Sentence
A successful appeal can be made against your conviction if it
can be shown to be unsafe. Your conviction may be unsafe if,
for example, the judge applied incorrect law or new facts come
to light after your trial. An appeal against sentence can be
made where the sentence imposed was manifestly excessive.
An appeal
can be made at any time, even if you have already appealed in
the past. The process of an appeal requires specialist legal
advice as your appeal may involve the Crown Court, the Court
of Appeal or the Criminal Cases Review Commission.
An appeal
should only be lodged if you have 'grounds' for an appeal. At
JMW our specialist lawyers will analyse your case and give you
straightforward advice, clearly stating your prospect of success.
