Her Majesties Revenue and Customs prosecutes its own cases. Those cases typically involve the importation of drugs or are cases of Tax frauds, also known as VAT/ Carousel/ MTIC.
It is clear that the HMRC have adopted a very aggressive approach when it comes to these types of matters. We have advised and assisted both individuals and organisations in relation to matters arising out of HMRC investigations and prosecutions.
Examples of our involvement include allegations of drug importation where HMRC investigations have led them to arrest a particular individual and prosecute those individuals for drug related matters. Thereafter, HMRC prosecutions allow them to pursue these individuals for Confiscation Orders which allow them to seize the assets of the individuals concerned. These seizures can be of a very substantial value and need dealing with.
We have also advised individuals and organisations where VAT has been an issue, in our capacity as solicitors instructed by Defendants and as solicitors instructed by organisations to recover outstanding VAT. It is quite clear that the approach adopted by the HMRC does not distinguish between fraudulent individuals and the innocent parties who are caught incidentally in those transactions.
