Mortgage Fraud


We have over many years built an expertise in mortgage fraud and have advised mortgage brokers and individuals on their respective positions when accusations are made of this nature.

It is quite clear that during the current economic climate that mortgage fraud will become more of an issue over the next 12-18 months. As more and more mortgages fail to be repaid, the banks, building societies and financial institutions will look at the original mortgage application in order to establish whether a fraudulent application has been made. But, customers beware of the Proceeds of Crime Act. Convictions for mortgage fraud can lead to confiscation orders that are equivalent if more than the value of the property that has been purchased! POCA is therefore a serious consideration.

In assessing whether mortgage fraud exists, it is important for an organisation to appreciate whether there has been any dishonesty in that process.  For an individual, they need to be reminded and advised on their position where an application for mortgage is being made.  Failing that, if criminal charges do follow, then again we are able to provide effective representation.
