Restraint Orders


When criminal investigations are commenced by the Police and involve the prosecution, in some cases the criminal assets are assessed to be of a substantial amount.  The authorities make an application to the Crown Court for a Restraint Order.  This Order effectively freezes the assets of the suspect.  Restraint Orders are very often not restricted to the Defendant themselves, but also apply to members of their family and people who have business or working relationships with them.  Restraint Orders typically cover spouses, girlfriends, partners, business associates and members of an individuals’ family.  Very often these people are not connected with any criminal offence or investigation, have no knowledge of a criminal offence being perpetrated but are very often the victims of a Restraint Order, which causes them a great deal of difficulty and inconvenience.


JMW have evolved a novel approach in dealing with Restraint Orders where they have been imposed against a particular party or individual where there is no suggestion of any involvement in a crime or criminal activity. We have been able to do this because our reputation and expertise in this area. We have been instructed in cases where we have been able to persuade the authorities to release funds to a spouse or partner; these range from small amounts of cash for daily living expenses to several hundred thousands of pounds representing half the value of all the assets seized!
