Other Motor Offences
Seatbelt cases
Recent legislation has made the regulations concerning seatbelts more stringent and we are able to advise in these types of case
Driving without insurance/licence/MOT certificate
Driving without, or failing to produce, these documents is an offence and, in the case of a failure to have insurance is treated seriously; it carries up to 8 penalty points and in the case of a young driver is likely to result in the immediate loss of a licence; we can advise you how to deal with any proceedings brought against you and we can deal with the case on your behalf in most circumstances, ie you will not need to attend court.
Failures to stop/report – Hit & Run
Commonly, but unfairly, referred to as 'hit and run' cases these are treated seriously by the courts and, in the most serious cases can attract 10 penalty points and imprisonment; it is vital that you are aware of the obligations which the law imposes upon you and that you seek advice from us about the separate offences of failing to 'stop' AND 'report'.
Probationary drivers
Stringent laws apply to 'new' or probationary drivers in the two year period immediately following the passing of the driving test and an accumulation of 6 penalty points in the relevant period results in revocation of a licence and a requirement that the test be passed again; in certain cases the impact of revocation can be avoided; we can advise you if you are likely to be affected by this.
Construction and Use cases
These cases involve allegations concerning construction and use and, typically, vehicle defects such as tyres, exhausts, mechanical parts, regulatory compliance and, particularly in the case of a corporate/business defendant can attract significant financial penalties; we have a thorough knowledge of the complex regulatory framework, its operation and enforcement.
Tachograph cases
We have substantial experience of guiding our business clients through the regulatory minefield, the definitions, exceptions, exemptions and defences and can advise you, proactively, through any investigation and any court proceedings which might follow.
